Summary: Use SideMind honestly, legally, and for the purpose it was built for. Do not use it to deceive, harass, or spam people.
1. Purpose
This policy describes how SideMind services may and may not be used. By using our service, you agree to comply with this policy. Violation may result in immediate termination of your service without refund.
2. Permitted Uses
SideMind services are designed and permitted for:
Responding to genuine inbound enquiries from potential customers of your business
Qualifying leads who have expressed interest in your services
Booking appointments with qualified prospects
Following up on missed calls and web enquiries in a timely manner
Reactivating leads who have previously engaged with your business
3. Prohibited Uses
You must not use SideMind to:
Contact individuals who have not expressed interest in your services or opted in to receive communications
Send unsolicited bulk SMS or voice messages (spam)
Deceive callers about the nature of the interaction in a way that violates Australian Consumer Law or the Spam Act 2003
Impersonate another business, individual, or entity
Collect sensitive personal information (health data, financial account details, government ID) without explicit consent and appropriate safeguards
Harass, threaten, or engage in any form of abusive communication with leads or customers
Violate any applicable laws including the Privacy Act 1988, Spam Act 2003, Do Not Call Register Act 2006, or Australian Consumer Law
Process leads or conduct campaigns for industries or activities that are illegal in Australia
Resell or sublicense access to SideMind infrastructure to third parties without our written consent
4. Compliance With Australian Law
You are responsible for ensuring your use of SideMind complies with all applicable Australian laws, including:
Spam Act 2003: You must have consent before sending commercial electronic messages. All messages must identify the sender and include an unsubscribe mechanism where required.
Do Not Call Register Act 2006: You must screen outbound call lists against the Do Not Call Register where applicable.
Privacy Act 1988: You must handle personal information in accordance with the Australian Privacy Principles.
Australian Consumer Law: All representations made through our agents must be accurate and not misleading.
5. AI Disclosure
SideMind agents are AI-powered automated systems. While we do not require you to proactively disclose this in every interaction, you must not instruct the agent to deny being an AI if directly and sincerely asked by a caller.
6. Reporting Violations
If you believe someone is using SideMind in violation of this policy, please report it to kevin@sidemind.com.au.
7. Enforcement
SideMind reserves the right to investigate suspected violations and to suspend or terminate service immediately where we determine a violation has occurred or is likely to occur. We will cooperate with law enforcement and regulatory bodies as required by law.
